The fact that there are many more beneficiaries of environmental protection than victims creates an incentive for either enterprising governments or opposition parties to rekindle public interest in the environment.

Unlike the limits to provincial powers discussed above, which concern federal constraints on the provinces' autonomy, the fifth restriction is imposed by the legal claims of provincial residents. 17 The Charter of Rights and Freedoms, which applies in all provinces, also may limit governments' prerogatives with respect to environmental protection. 18 Sources of Federal Authority Unlike the 'property and civil rights' clause, which gives the provinces extensive regulatory powers concerning the environment, the federal government's environmental jurisdiction is more indirect and uncertain.

Intragovernmental politics could be particularly significant in situations where the environment department seeks to regulate the activities of another department within the same government. Although in theory any differences would be resolved within cabinet, with both sides adhering to the government position thereafter, in practice, the 'losers' in an intragovernmental struggle may look to outside constituencies or the other level of government for support.
